Terms and Conditions
These are the terms and conditions for accessing and making a post to the Tasmanian Water Trading Notice Board (“the Notice Board”). Tasmanian Irrigation Pty Ltd (“Tasmanian Irrigation”) is the owner and operator of the Notice Board. Tasmanian Irrigation may change these terms and conditions at any time by publishing variations on this website. By accessing and using the Notice Board (including making a post to the Notice Board), you agree to be bound by these terms and conditions, as amended from time to time.
Relationship with Tasmanian Irrigation and other users
You acknowledge that the Notice Board is merely a free service provided by Tasmanian Irrigation to assist in matching potential buyers and sellers of water entitlements.
You agree that Tasmanian Irrigation:
may refuse to provide this service to you for any reason it thinks fit;
is in no way a party to any contractual relationship between any users of the Notice Board; and
does not personally offer to you, or endorse or recommend any of the water entitlements listed on the Notice Board.
Making a Post
In order to post an advertisement on the Notice Board you must post full and accurate details of your listing to the Notice Board. Your post to the Notice Board is subject to the final approval of Tasmanian Irrigation.
Accuracy and Currency of Information
You agree that the information contained in any post that you make is an accurate reflection of your intentions and capability with respect to buying, selling or leasing water entitlements. You agree to immediately notify Tasmanian Irrigation of any change in your intentions or capability with respect to buying, selling or leasing water entitlements so that your post can be updated or removed.
The information contained in a post may not necessarily have been assessed for accuracy by Tasmanian Irrigation. Accordingly, Tasmanian Irrigation does not warrant the accuracy of the information contained in the Notice Board. By accessing the Notice Board, you agree that you are solely responsible to assess the accuracy of information and that you rely on the information contained in the Notice Board at your own risk. In particular, Tasmanian Irrigation does not warrant that a person’s intentions and capability with respect to buying, selling or leasing water entitlements is accurately reflected by the information contained in a post, or that the information contained in a post is current at the time of viewing or that a post has been made according to instruction. .
Outages
You agree and acknowledge that the Notice Board may not be secure, operate in an uninterrupted manner, or be available at all times.
Cookies
This website uses cookies. Cookies are small amounts of information in the form of text files which Tasmanian Irrigation stores on your computer. Cookies allow Tasmanian Irrigation to monitor usage of the Notice Board, improve the Notice Board’s usability and to personalise the content for you.

Tasmanian Irrigation may collect your personal information for the purposes of advertising water entitlements on the Notice Board on your behalf.

Intellectual property
All intellectual property in relation to content on the Notice Board belongs to Tasmanian Irrigation. You obtain no interest in that intellectual property. You must not do anything which interferes with or breaches Tasmanian Irrigation’s intellectual property rights.
Liability
To the extent permitted by law, Tasmanian Irrigation will not be liable for any direct, indirect, incidental, consequential, special, exemplary or other damages (including loss of profits, goodwill, information, data or other intangible losses) that you may suffer arising out of any access of, or any other matter related to, the Notice Board.
Nothing in these terms and conditions excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Competition and Consumer Act 2010, or any other applicable law that cannot be excluded, restricted or modified by agreement.
Indemnity
To the maximum extent permitted by law, you indemnify Tasmanian Irrigation, and each of its directors, officers, employees and agents against any direct or indirect damages, action, claim or loss (including legal fees) which Tasmanian Irrigation may incur in connection with:
your use of this website and the Notice Board;
any inaccuracy in any of your warranties to Tasmanian Irrigation or any third party in connection with the Notice Board; or
your breach of any obligation, representation or warranty in these terms and conditions, except to the extent that the relevant damage, liability, cost or expense is caused by Tasmanian Irrigation.
Jurisdiction
The law applicable to the use of this website, the Notice Board and to these terms and conditions is Tasmania, Australia and the parties submit to the exclusive jurisdiction to the courts of Tasmania in relation to any matters arising under these terms and conditions, or in relation to the use of the Notice Board.
Invalidity
If any of these terms and conditions are for any reason declared invalid or unenforceable, the validity of the remaining portion is not affected and the remaining portion is to remain in full force and effect as if these terms and conditions has been agreed with the invalid portion removed.
